Terms of Service

Effective: July 4, 2022

These Terms govern access to Togethers websites, applications, rooms and related watch-party services. By accessing or using Togethers, you agree to these Terms. If you use Togethers for an organization, you confirm that you are authorized to accept these Terms for that organization.

1. Eligibility and accounts

You must be at least 13 years old and legally able to enter into this agreement. Registration information must be accurate and kept current. You are responsible for safeguarding your login credentials and for activity performed through your account.

2. Rooms and shared content

Togethers may let users create rooms, browse websites together, communicate and share content. You remain responsible for anything you submit, stream, display or make available through the service. You must hold the rights and permissions required for that content.

You keep ownership of your content. You grant Togethers the limited worldwide permission needed to host, transmit, format and display that content solely to operate, secure and improve the service. Content shared in a room may be visible to other room participants and should not be treated as confidential.

3. Acceptable use

You may not use Togethers to:

• break applicable law or infringe intellectual-property, privacy or publicity rights;
• harass, threaten, defraud, impersonate or harm another person;
• share unlawful, malicious, deceptive or unauthorized material;
• introduce malware, disrupt the service or bypass security and access controls;
• scrape, probe, reverse engineer or commercially exploit the service without permission; or
• encourage another person to perform any prohibited activity.

Togethers may restrict room names, remove content, limit access or suspend accounts when reasonably necessary to protect users, third parties or the service.

4. Service changes and availability

Features may change, be interrupted or be discontinued. Togethers does not promise that every website, stream, device or third-party service will remain compatible or continuously available.

5. Paid features

Prices, renewal periods and applicable charges will be disclosed before purchase. When a subscription renews automatically, you authorize the payment processor to charge the saved payment method until cancellation. Refunds are provided where required by law or where Togethers expressly agrees otherwise.

6. Intellectual property

Togethers and its licensors retain all rights in the service, software, design, trademarks and original materials. These Terms do not transfer ownership of Togethers technology or branding to users. Copyright complaints are handled under the Copyright & IP Policy.

7. Third-party services

Togethers may open or interact with websites and services operated by third parties. Their own terms and privacy rules apply. Togethers is not responsible for third-party content, availability, security or transactions.

8. Suspension and termination

You may stop using the service at any time. Togethers may suspend or terminate access for a breach of these Terms, legal or security risk, repeated infringement, non-payment or conduct that threatens the service. Provisions concerning ownership, liability and disputes survive termination where their nature requires it.

9. Disclaimers and liability

The service is provided on an “as available” basis to the extent permitted by law. Togethers disclaims warranties that cannot reasonably be given for an online collaborative browser. To the maximum extent allowed by law, Togethers is not liable for indirect, incidental, special or consequential loss arising from use of, or inability to use, the service.

10. Privacy

The Privacy Policy explains how information is collected, used, retained and shared.

11. Changes and general terms

These Terms may be updated when the service, law or operating practices change. Updated Terms become effective when posted unless a different date is stated. If one provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver of that provision.
